Description of the
Building permits, partial building permits and preliminary decisions are only valid for a certain period of time.
If you are unable to start your authorised project within 4 years, you can apply for an extension. If you do not receive planning permission for the same project within 4 years of receiving a preliminary decision, you can apply for an extension of the preliminary decision.
The extension period is up to four years, multiple extensions are possible.
Prerequisites
An extension of the period of validity of a building permit or partial building permit is to be assessed on the basis of the same requirements as the initial granting. The project must therefore still be subject to authorisation at the time the lower building supervisory authority decides on the extension. In addition, the project must comply with public law regulations, which must be examined in the authorisation procedure.
This applies accordingly to the extension of the preliminary decision.
If the legal situation changes after the authorisation or preliminary decision has been issued, the extension must be checked against the new legal situation.
Deadlines
Your building permit or partial building permit will expire if you have not started work on the project within 4 years of it being granted or if you have interrupted construction work for 4 years. Your application for renewal must be received by the responsible lower building supervisory authority before the expiry date. Receipt by the municipality is not sufficient to meet the deadline.

Costs
You will have to pay a fee of between EUR 40 and EUR 10,000 for the extension, depending on the administrative costs incurred.Legal basis

Legal remedy
You can appeal to the administrative court against a decision by the lower building supervisory authority regarding the extension.
Procedure
Written submission
- Apply in writing to the responsible lower building supervisory authority for an extension of the validity period of your building permit, partial building permit or preliminary decision.
- An oral application is not possible.
- The lower building supervisory authority will then decide on your application and inform you of the result.
- If the lower building supervisory authority only decides on your application after the period of validity has expired, your building permit, partial building permit or preliminary decision will become temporarily invalid. These will then only be reinstated once the lower building supervisory authority has issued a favourable decision.
Digital submission
Digital submission of applications for renewal is not yet possible throughout Bavaria. When selecting a location, the link to the online procedure will be displayed if it is already available.
- The application for extension can be submitted digitally to the lower building supervisory authority using the online assistant.
- Attachments are uploaded to the online assistant in electronic form (files in PDF format).
- The signatures are replaced by authentication using the "BayernID" user account or "My company account".
Notes
Apply for an extension in good time if it is foreseeable that the period of validity will not be sufficient.

The processing time depends on the scope and complexity of the project and the current capacity utilisation of the lower building supervisory authority.
