Under the Bavarian Water Act, wastewater disposal is a statutory duty of municipalities and towns, which they carry out within their own jurisdiction. To this end, municipalities and towns (or, where applicable, municipal wastewater associations) construct and operate sewer networks (for the collection and conveyance of wastewater) and sewage treatment plants (for the treatment of wastewater).
Wastewater may only be discharged into water bodies if its quality meets certain minimum requirements, which are laid down uniformly across Germany in the Water Resources Act and specified in the Wastewater Ordinance.
To enable municipalities and towns to collect the wastewater and comply with the requirements, they regulate the extent of the municipal area to be connected to the sewerage system, as well as the requirements regarding the type and quality of the wastewater to be discharged into the sewerage system by households and commercial enterprises, through the municipal drainage regulations. The Contribution and Fee Regulations govern the financing of wastewater facilities through (one-off) contributions and (recurring) fees. In those areas of the municipal territory where no public sewerage system is installed, proper wastewater disposal is the responsibility of the property owners and is usually carried out via small-scale treatment plants.
