Description of the
The purpose of urban land-use planning is to prepare and guide the development and other uses of land within the municipality in accordance with the Building Code.
Urban development plans comprise the land-use plan (preliminary urban development plan) and the local development plan (binding urban development plan).
The local development plan sets out the manner in which plots of land may be developed. For example, you will find provisions
- regarding the nature and extent of the building’s use,
- on the permitted number of storeys and
- on permissible roof shapes.
In particular, the development plan must be accompanied by an explanatory statement. This contains explanations of the planning objectives and the provisions set out in the drawings and text.
In the land-use plan, local authorities set out the broad outlines of their intended urban development.
In it, you will find, for example, information on planned
- Residential land,
- Commercial and industrial development sites,
- Green spaces or
- Traffic areas.
The accompanying explanatory notes set out the objectives of the planning process and the information contained in the land-use plan.
Under Section 6(5), third sentence, and Section 10(3), second sentence, of the Building Code (BauGB), any member of the public may inspect the land-use plan or development plan and request information regarding its contents.
Costs
The town planning maps can be viewed free of charge online. They can also be viewed free of charge at the local council offices.
Extracts from the local development plan or the land-use plan can be obtained from the local authority, either in printed or digital form, subject to a fee where applicable.

The information system allows you to access development plans and land-use plans for numerous local authorities in Bavaria. This service does not replace the legal validity of the original plans. Only the original plan sets out the valid legal position within the meaning of the Building Code.

Procedure
Current local development plans and valid land-use plans are to be made available via the central state portal and on the municipalities’ websites. This is mandatory for documents relating to public participation procedures under Section 3(2) of the Building Code.
You can also request information on development plans or land-use plans from the local council. If you would like to know more about development plans relating to a particular plot of land, you will need to be able to provide details of the plot in question (e.g. cadastral district, parcel number or address).
There is a legal right to inspect the development plan and to receive information from the local authority. This right may be asserted before the competent administrative court; the relevant legal action is an action for performance.
