Description of the
Under Article 83 of the Bavarian Constitution, local authorities are responsible for housing supervision. The specific powers of intervention under housing supervision law (e.g. ordering the rectification of deficiencies) ceased to apply following the repeal of the Housing Supervision Act on 1 January 2005, as the legislature considered the civil law provisions of tenancy law and the instruments available under security law to be sufficient.
Local authorities have at their disposal the general publicpowers under the law governing misuse of property, building regulations, public health or general safety to take effective action against abuses and problem properties arising from the disrepair or neglect of housing or from overcrowding.
