Description of the
Socially subsidised rental accommodation is subject to occupancy restrictions. This creates an obligation for the person authorised to dispose of the subsidised rental accommodation to only let it to people who meet certain requirements.
In individual cases, there may be sufficient reasons to permit the transfer or use of the tied housing in derogation of the occupancy restrictions. To this end, an application must be made to exempt the socially tied housing from occupancy restrictions. In contrast to a release from the occupancy restrictions, the exemption can only be granted for a limited period of time.
Prerequisites
The competent authority may temporarily release the authorised person from occupancy obligations if
- there is no longer an overriding public interest in them, or
- adherence to these is no longer required due to an overriding public interest, in particular the creation or maintenance of socially stable resident structures or an overriding legitimate private interest.
