If you wish to display posters or similar material in public, you must check whether the local authority has restricted this to specific areas. Section 28 of the Bavarian State Penal and Regulatory Act permits local authorities to impose such restrictions, provided this serves to protect the appearance of the town or countryside, or a natural, artistic or cultural monument. An intentional or negligent breach of such a municipal regulation constitutes an administrative offence, which may be punished by a fine. In addition, the local authority has the option of demanding the removal of the notice.
The content of the notice is, in principle, irrelevant. Commercial advertising – provided it is not already covered by the Bavarian Building Regulations as a (permanent) advertising structure – may fall under this category, as may political advertising or private notices.
You can find out from your local authority whether it has issued a relevant regulation and what restrictions it contains.
Please also note that, depending on the type, size and location of the notice, special restrictions may apply in certain circumstances. This applies in particular to- Fixed installations for commercial advertising, which may require planning permission,
- Poster stands in traffic areas that must not obstruct traffic and may require a special use permit under road law,
- Devices that resemble signs or traffic facilities, can be confused with them or can impair their effect and are therefore not permitted where they may have an effect on traffic,
- Advertising and propaganda in connection with traffic signs and traffic facilities, which is not permitted,
- Installations that are to be erected on or near a listed building and may therefore require a licence under monument protection law,
- Posters that are to be affixed in areas that are particularly protected under nature conservation law, e.g. nature reserves, landscape conservation areas or nature parks, and are therefore prohibited under certain circumstances.
