Description of the
The State Treaty on Gambling 2021 pursues the following objectives, among others:
- Preventing and combating gambling addiction,
- Preventing the emergence of a gambling black market,
- Steering the urge to play into orderly and controlled channels,
- Youth and player protection,
- Fraud prevention,
- Furthermore, protection of the integrity of sporting competition when organising and brokering sports betting.
In order to better realise these objectives, the State Treaty prohibits the organisation and brokering of public gambling without a licence.
Advertising for authorised gambling is permitted in compliance with the requirements of Section 5 GlüStV 2021, but the type and scope of advertising for public gambling must not run counter to the objectives of the Interstate Gambling Treaty and the advertising must not be excessive. Advertising for unauthorised gambling is prohibited.
The gambling supervisory authorities have the task of monitoring the fulfilment of the public-law obligations associated with the Interstate Gambling Treaty 2021 and working to ensure that the organisation or brokering of unauthorised gambling and the advertising thereof does not take place. To this end, they can issue the necessary orders in individual cases within their area of responsibility.
Competent authorities
The competent gambling regulatory authorities in Bavaria are the local authorities, the district offices, the regional authorities and the State Ministry of the Interior, Sport and Integration, acting as security authorities.
The Joint Gaming Authority of the German States (GGL) is responsible for regulating unauthorised public gambling and advertising for such activities that are offered online in more than one state.
