Under Section 43 of the Bavarian School Enrolment Act (BayEUG), in conjunction with the provisions of the Ordinance on the Procedure for the Approval of Guest School Placements (GastschulV), an exemption from the school catchment area may only be granted on the grounds of compelling personal reasons on the part of the applicant.

Compelling personal reasons
The following are considered compelling personal reasons:
- The child has moved during the current school year, but should remain in his/her usual class community.
- The child will move during the current school year, but should attend the future Sprengelschule from the beginning of the school year.
- You are a working parent/single parent and it is therefore not possible to look after the child independently outside of school hours. The child should therefore be looked after in the host school district.
- The child should attend an after-school care centre in the host school district, as there is no capacity in the after-school care centre of the responsible district school.
No compelling personal reasons
The following criteria are not considered compelling personal reasons:
- The child has attended a kindergarten in the past that is located in the area of the host school.
- Friends of the child attend the host school.
- A longer journey to school (unless there are special, proven circumstances).
- Escort to and from school (provided there are no proven special circumstances).
