The town of Kitzingen is the lower-level heritage protection authority for the town centre and the districts of Hoheim, Hohenfeld, Repperndorf and Sickershausen, and is therefore responsible for enforcing the Heritage Protection Act.
Monument protection
Approval & authorisation notices
As a general rule, measures relating to architectural or archaeological monuments, buildings forming part of a protected ensemble, or movable monuments listed on the register of monuments, only permitted if the local heritage protection authority has granted prior permission or if planning permission has been granted.
Anyone wishing to carry out building works on a listed building or a building forming part of a listed ensemble, or who simply wishes to seek advice, should therefore contact the local heritage authority at an early stage.
All advisory services and planning permission notices issued by the heritage authorities are free of charge.
By contrast, the usual cost arrangements apply to planning permission relating to listed buildings.
Funding
Under the Heritage Protection Act (DSchG), owners of listed buildings are obliged to maintain and repair their listed buildings, treat them with due care and protect them from harm, insofar as this can reasonably be expected of them.
The costs of maintaining and repairing a listed building can sometimes exceed the owner’s financial means. Therefore, under certain conditions, it is possible to apply for grants from various funding bodies.
Subsidies are only available for costs which, due to heritage conservation requirements, exceed the usual maintenance costs (additional heritage conservation costs).
All grants are channelled to the funding bodies via the Local Heritage Protection Authority of the City of Kitzingen.
Applications for funding can be made to the following funding bodies:
Applications can be submitted collectively via the local heritage protection authority, Ms Ilg.
- Bavarian State Office for the Preservation of Historical Monuments (BLfD)
- Lower Franconia District
- Kitzingen District
- Large district town of Kitzingen
- Grants and loans from the compensation fund
- Grants and loans from the Bavarian State Foundation
Please note: Funding will only be granted if the measures have been agreed with the Bavarian State Office for the Preservation of Historical Monuments prior to their implementation. Furthermore, work on the measures may not commence until the grant approval notices from the individual funding bodies have been received. Please note that there is no legal entitlement to funding.
Tax benefits
In addition to grants, which may be awarded on a case-by-case basis, there are a number of tax incentives available in relation to the protection and preservation of historic buildings.
In order to claim tax relief for the protection and preservation of historic monuments, a certificate must be submitted to the tax authorities; for properties in Bavaria, this certificate is issued by the Bavarian State Office for the Preservation of Historic Monuments.
The certificate may only be issued for listed buildings and cultural assets worthy of protection within the meaning of the Monument Protection Act (DSchG), and for measures which have been agreed with the Bavarian State Office for the Preservation of Historical Monuments prior to their implementation.
